Like a real paper question... are you using us to do all your essays through these posts? Very sus.
Anyhow, I think that communities should be responsible to identify when a person needs mental care. In most cases a family member or a medical practitioner should ensure that a person who is mentally unstable is getting proper surveillance and care. Thus, if at this time the person in question commits a crime, the carer/s of that person should take some responsibility (relating back to your other post here now) for allowing that to happen; the same way a parent is responsible for leaving their young children to burn down the house.
The only example I can think of is with my mum. She suffers from a number of mental conditions which thesedays are managed by medication. However, when I was eleven I was her carer and sometimes if I left the door unlocked she would sneak out of the house and end up committing petty crimes - while unconscious of her actions. Now, being an 11 year old myself I don't think that I should have been held responsible but I do believe my extended family and medical practitioners who knew our situation and did nothing should have been held to some account.
In the case where there is no evidence of prior mental imbalance or extremely abnormal emotional pressures on the person (such as severe consecutive changes related to death, bankruptcy, divorce etc), then it should be assumed the crime was done consciously.

The spirit world exists and when you let go of reasoning (reasonable thought) you can begin to see them. The thing is when you let go of reasonable thought, technically you are insane. The differences between spiritualists and psychopaths, is that a spiritualist choses to let go of reasoning. A psychopath loses his/her ability to reason, through no choice of his/her own. Things like low levels of Seratonin are usual causes of this loss of reasonable thought.
A psychopath cannot handle the spirits they see when they open up. That is why its better to close them up with medication

So what SPMM KK, all psychopaths see spirits?
I don't believe communtities should be responsible for identifying mentally unstable people; it sort of reminds me of the witch trial effect, where as a disgruntled neighbour claims the person she is living next to is crazy and they get locked up...extreme yes; but thats what I think of.
Family close friends and doctors should be the people should be responsible because they know the person better then anyone else. They would notice the out of character things the individual would do.
How do you determine it in court? Well, there should be medical evidence of instability, depression etc...a person can't go crazy overnight, without tell tale signs being noticed.

not all of them see spirits but most schizophrenics do. Seeing spirits is ok as long as one can handle it without causing harm to others.

Thats a first SPM KK I didn't know schizophrenics could see spirits...I know they hear voices and fell as though they are being control by an outside force...

some phenomena are beyond scientific reasoning...as long as its not your own shadow or some other scientifically explainable phenomena then it counts as a paranormal/spiritual experience
